KUALA LUMPUR, June 12 — Parti Keadilan Rakyat (PKR) advisor Datuk Seri Anwar Ibrahim's application for the prosecution to provide him with all documents pertaining to his sodomy case will be heard on June 22.
Anwar's counsel, S.N. Nair, said he was notified by the court today that the matter would be heard by High Court judge Datuk Mohamad Zabidin Mohd Diah.
Anwar filed a notice of motion on Wednesday requesting the court to compel the prosecution to provide him with the documents before his sodomy trial on July 1-24.
Among the documents are the original CCTV recordings taken at several locations at the scene of the alleged incident at the Desa Damansara Condominium, Jalan Setia Kasih, Bukit Damansara, from June 25 to 27 last year, the DNA samples, statements from witnesses including the complainant, Mohd Saiful Bukhari Azlan, police statements and several other documents.
He applied to the court to acquit and free him immediately of the sodomy charge or to suspend the proceedingspermanently if the public prosecutor did not comply with the court order to supply him with the documents concerned.
Anwar, 61, is charged with sodomising Saiful, 23, his former personal aide, at Unit 11-5-1, Desa Damansara Condominium, Jalan Setiakasih, Bukit Damansara here between 3.01pm and 4.30pm on June 26 last year. — Bernama
Brader Anwar has always been poor at strategy. Under the all important “Criminal Procedure” in the Courts, the Prosecution is obliged to disclose all relevant information and evidence to the Defense.
So if Brader Anwar thinks the Prosecution is withholding information or evidence, it is better for Brader Anwar jangan cakap apa-apa. Diam saja. Then when the Prosecution concludes their case, Anwar’s lawyer can ask for the case to be dismissed on the grounds that the Prosecution withheld disclosing information and evidence.
But lets look at the list he has requested : “.original CCTV recordings taken at several locations at the scene of the alleged incident at the Desa Damansara Condominium, Jalan Setia Kasih, Bukit Damansara, from June 25 to 27 last year, the DNA samples.”
How can he ask for the original CCTV recordings? Tak masuk akal lah. What happens if after he gets it, Brader Anwar accidentally damages or destroys the original CCTV recordings? Then no more evidence maa. Ask for copy lah.
What DNA samples? What is Brader Anwar talking about? The case has not started. He said he has not sodomised anyone. So how does he know there are DNA samples involved? Hmm … . .
But how can he ask for the original DNA samples? Mana ada? According to world renowned forensic Blogger Dr Parpukari, in sodomy cases, male semen can still be deteced up to 72 hours after the act. If the forensics guys can extract the sample within that time, then of course they can run a DNA test on the sample.
Once the DNA test is completed the results are documented. I think Brader Anwar can ask to have a copy of the Forensic Department’s DNA Report. But not the original sample lah Brader ! Lojik lah sikit.
But we can see his tricks again. Brader Anwar is playing to the gallery again. He is asking for things which may not be possible for the Court to give him. Then he can go to all his ceramah and say there is a conspiracy to withhold evidence and information from him.
Do you recall in the first case where Brader Anwar was found guilty of abuse of power, he had instructed some Police guys to bully Ummi Hafilda, force her to write a retraction (confession lah) then post the retraction to Dr Mahathir. The dumb nuts put Ummi’s retraction in an envelope, sealed it, put a stamp on it, went to the Post Office and got the letter ‘chopped’ by the Post Office (to make it look like the letter had come through the regular postal delivery) and then after that they hand delivered the letter to Dr M’s office where the Clerk duly recorded that the letter was hand delivered by some Police guy (and not the Postman).
How stupid could they get? There was a complete trail of everything they had done, step by step.
It looks like the Brader Anwar Bin Ibrahim circus is starting again. Free entertainment for everyone. Stronger stomach may be necessary this time.
We do not know what will be the outcome of the case. But whatever the outcome, I just hope the Prosecution does not bungle handling the case like they did the first time around in 1998.

Maybe the prosecution should also obtain all the original materials the accused has for his defence (including the names of defence witnesses). That is only fair.
The outcome is not important... what's important is that the trial will heat up political atmosphere and speed up Umno's demise. If police chief does something to Anwar physically, it will be "better"... if I were Anwar (at 61 years old), I would rather go to jail if that can help the opposition destroy Umno

That's a good one! Perhaps they'll even call him to the stand to testify!! Lol.

I agree with you. How can he ask for the originals? However, since I have not seen the actual request letter written to the court, I wonder whether it is the editors at Bernama who paint such a picture for people like you and me to be "guided".

My view is that a man is innocent until proven guilty. In Brader Anwar's Sodomy I case, the evidence was so flimsy that any law student can tell you that there was plenty of reasonable doubt involved. As such, the fact is Brader Anwar was acquitted in the Sodomy I case .... eventually, much to the dismay of his previous boss.
Is Brader Anwar guilty the second time around ? Maybe, but the known facts that are available indicate that the "victim" was not sodomised at the first medical examination but the second examination 4 hrs later seemed to indicate that there was some evidence. But was Brader Anwar with the victim in the intervening 4 hrs ?
Now, it could be determined that the victiom was actually sodomised by the time of the second examination but maybe, just maybe it was done by someone else ???
Presumably, the prosecution need not provide the evidence to the defendants before the hearing but if they do not have solid evidence, ie undoctored CCTV clips, DNA samples, medical reports, etc .. then please don't waste taxpayers money barking up the wrong tree.
One only needs to be reminded in the Kugan case how even the Direcor of Medical Services can do taichi to protect the wrongdoers by not pointing the finger at them.
Politics is the one single highly matable disease of mankind.This sickness infect all that it comes into contacts with,such as,families,corporation,nations and even institution of welfare,education and religions are not spared.
The only bastion left to counter the deception of politics are the kithab handed down to us by the many prophets.
In the coming years,the masses will wake-up and return to religions as more become aware of the evil of politicians.
Anwar is a politician and like the proverbial leapord will NEVER loose its spots.

People have been fornicating (this work can use ah? non seditious right?), men disguised as woman or woman disguised as ninjas, coming in and out of apartments in hijab for example, ( the concubine costume..how cynical), and can even record their indoor activities and title it "Forest Hump", and get away with it, exactly what purpose does the CCTV serves, ori or tak ori?
He should just call out for 4 saksi from JAKIM or JAIS, or badan badan yang sewaktu dengannya, to be produced.

If let say after being sodomized, the victim kena diarrhoea....the evidence will be washed away...or if the anal sphincter longgaq oredy, also same thing, all the notty sperms escape through..very tricky lah this case.

I thought Anwar claimed that the coming trial is a "political conspiracy" against him by the Ruling Government aided and abetted by the AG and the IGP, so why this sudden need by Anwar's lawyers to have evidence which is "fabricated" by the police and the IGP.
Just wait for the trial to start and after the Prosecution have finished presenting their case then defense lawyers should just rebut that the evidences and the main witness are all fabricated lies lah, this is more believable then asking the Court to throw out the sodomy case even before the trial starts, if the Prosecution refused to share its evidence with them beforehand.
I think some one is seriously in a state of terror of his appointment with the court on 1 July 2009 to be even thinking about this cheap stunt.

I am so bored with reading all this crap that is going around us, I need something to at least make me laugh or smile. The only thing that is left that is good for our system besides solat and dhikir, is a smile or a laugh, by whatever cranky way, to let loose those endomorphines stuck within us,that will give us a natural high and overall good feeling.
Support the Gomen useless. Support PKR also useless. We all die standing la. No laughing matter but if no laugh, really die standing!!I think that is why the Sifu from Singapore came la. He also knows that the country is going to the dogs. And Singapore, whether they like it or not,needs a strong and reliable Malaysia to survive.
